Building contractor ordered to pay €62,288.74, plus statutory interest and legal costs
Dpcon S.L. has once again obtained a judgment upholding our clients’ claim in full against a building contractor that was hired to build a detached house but complied neither with the deadlines nor with the correct execution of the works.
This was despite the fact that the owners had advanced it a considerable amount of money. The contractor kept making repeated excuses, repeatedly missing the new deadlines it set itself, to the point that, in the end, it failed to fulfil its side of the agreement, abandoning the works
/abandono-de-obra-por-constructor/ and postponing their completion « sine die », taking as long as a year and a half.
For this reason, one of our experts carried out a settlement of accounts and valuation comparing the amounts paid with the work actually carried out by the contractor, also deducting defects in execution and items that would have to be redone, plus a penalty based on a late-completion penalty clause imposing €50 for each day of delay.
The Juzgado de Primera Instancia de Talavera de la Reina has found in favour of our clients, upholding the claim in full, terminating the construction contract for breach by the contractor and ordering the defendant to pay them €62,288.74, plus statutory interest and legal costs.
