You may have contracted directly with the installation company (for example, if you own a detached house), or solar panels may have been installed defectively in your building so that they do not work properly. In either case you can claim against the installation company under the contract you signed, or claim for the damage within the period the LOE sets for defects in solar panels.
Incorrectly installed solar panels
The problems caused by poor installation of solar panels can vary: batteries that discharge quickly, batteries that do not charge despite many hours of sunshine, panels that are poorly anchored and may come loose, an incorrect installation angle, frequent power cuts, shaded areas and so on. Find out your options if you want to take action against those responsible.
Time limit for claiming for poorly installed solar panels in homes
There is a legal guarantee period of 3 years from the handover of the works (when the work is officially completed) to claim for this type of damage under the Spanish Building Act (LOE). If the claim is not brought within the time limits of that law against those involved in construction, but against the contracted company under the contract you signed with it, the period is about 5 years under the Civil Code.
