If you are considering claiming for problems in the electrical installation of your home or your homeowners’ association, regardless of your contractual rights, bear in mind that this installation, as an integral part of the building, has a legal guarantee period of 3 years to claim for its defects under the Spanish Building Act (LOE), since it is regarded as a basic requirement of the building.
Liability for faulty electrical installations
All projects, including electrical installations, must be legalised and coordinated throughout the construction process, with their corresponding installation certificates, licences, industry approval and so on, and the supplier or installation company must be clearly identified. If the work is subcontracted, the developer is jointly and severally liable for the deficiencies of the installation. Article 4.2 of the LOE states that when the work is developed through partial projects or other technical documents on specific technologies or installations of the building, the necessary coordination must be maintained between all of them, without duplicating documentation or fees.
How to claim for faulty electrical installations in a home
To claim for problems or defects in the electrical installations of a property, the first step is to have a specialist draw up an expert report identifying the problems. On the basis of that report, lawyers specialising in construction law can sue those responsible. Please contact DPCON for a quotation.
