The specialisation of the architect and lawyer handling the claim for construction defects in your home or homeowners’ association is vital to its success.
Architects and lawyers do not do a residency like doctors, and they do not leave university as specialists “in…”.
Experience, courses and above all clients are what make an architect or a lawyer a specialist. But that does not mean that, in the absence of such a qualification, clients should be misled.
When you have a heart condition, you do not go to a general practitioner; common sense tells you to look for a specialist. The same common sense should also be applied when choosing the right architect and lawyer to claim for construction defects in a building.
The worst mistakes we have seen made have always been by architects or lawyers who were not specialists in the matters concerned, chosen by the client only for reasons of family, proximity to work, friendship or chance. Nor did the professional chosen know to turn the case down. It would be unthinkable for a junior doctor to be left alone in an operating theatre to perform open-heart surgery, or for them to agree to do so, without being a specialist.
A doctor may lose a patient, who ultimately dies, but because of advanced age or an incurable illness. The doctor has done what they could. The tragedy is when it is a young, healthy person who should not have died.
It is true that seasoned architects and lawyers specialising in construction defect claims lose cases. But the worst thing is to see cases that should never have been lost, where only the inexperience in that field of the professional handling them caused them to be lost entirely.
As a precaution, and for your own good, do your research and put yourself in the hands of professionals who have experience in, or specialise in, the matter that concerns you. If it is a construction matter, contact and hire a lawyer who specialises in that area of liability and an architect who likewise specialises in analysing these kinds of defects and has experience in court.
Because all of us, doctors as well as lawyers and architects, neither know about nor are suited to everything; but each of us, in our own field of specialisation, is indeed of great use and value.
