Although the LOE does not mention the possible liability of the building quality control bodies and laboratories it refers to, their liability is implicit in what they do.
Although their involvement in the construction process is not mandatory, they will be liable to the extent that they take part in it. Quality control bodies will be liable, whatever the cause of the damage, if they took part in the quality control of the construction phase in which that cause arose, since their role is to verify the quality of the project, of the materials and of the execution of the works and its installations. Similar considerations apply to laboratories: they will be liable if the damage is caused by the materials, systems or installations that were the subject of the tests or trials they may have carried out.
In addition to the insurance provided for in article 19 of the LOE, owners can also rely on the civil liability insurance that building quality control bodies and laboratories are obliged to take out in order to obtain the corresponding accreditation.
