A recurring problem in homeowners’ associations and in detached houses is often the installation of the domestic hot water (DHW) system.
Although a domestic hot water system is very useful and has many advantages, making the building comfortable, when it is installed incorrectly it causes many problems and adversely affects the habitability of the homes.
If there are problems with the DHW installation, a specialist expert should inspect it to establish what the problem is, its origin and cause, and to propose a repair or provide a quote from a specialist company. Unfortunately, solving some DHW installation problems is expensive. But the owners should not have to bear that cost.
To claim the repair or its cost, an action can be brought under the Spanish Building Act (Ley de Ordenación de la Edificación, LOE), as it is a significant habitability defect within the 3-year guarantee period, against both the installation company and the technical professionals responsible; or a claim can be made directly against the developer as seller, on the basis of contractual liability, within a period of 5 years.
