Has there been a burst near your home and, as a result, have cracks and/or damp or water ingress appeared in your home?
Don’t let it slide: you only have one year to claim for the damage.
When there are defects in the drainage network and they cause damage to property, the public authorities are liable for the malfunctioning of a public service.
The main problem is that the claim must be made within one year of the event giving rise to liability, and the cause-and-effect relationship between this malfunction and the resulting damage must be fully proven.
That is why, if you suspect that the origin of this sudden damage is a burst in the water supply network, you need to:
1) Put the existence of the burst on record in writing. You must prove when the harmful event occurred or when the damage became apparent. Report it to the Guardia Civil, submit a written notice to the Town Council, and film or photograph it.
2) Commission an expert report that values the repair of the damage to your home and proves that it was caused by the burst in the drainage network.
3) Submit a claim to the public authorities providing all the documents on which your right is based (the police report, the title deed to your home and the expert report).
We will be delighted to help you. If this is your situation, do not hesitate to contact us.
