It is no excuse that the development was promoted by another company.
The new buyers of homes in a building marketed by Servihabitat in the Andalusian city are finding, despite having paid a considerable price, unpleasant surprises in their homes. These properties suffer from many problems that are seriously affecting the first occupation of the flats.
In particular, there is widespread poor workmanship in the toilet traps and in some trap pipes and downpipes, with the serious problem this poses for the habitability and hygiene of the homes. This is without prejudice to other lesser problems which are not trivial either, such as faults in the air-conditioning and home automation pre-installations.
Although construction of the development began several years ago, as the company promoting the works went bankrupt, the building was seized and awarded to a bank. Consequently, the works were resumed and completed through Servihabitat, and the homes were advertised and put up for sale.
So it is no excuse that the development was started earlier by other parties involved in the construction and that the negligent work was carried out at that time, given that once the works are resumed, what was done before is taken on, and by certifying the works, the new parties involved in the construction answer for everything having been carried out properly and in accordance with the project.
And Servihabitat must answer not only under the guarantees covered by the Spanish Building Act (Ley de Ordenación de la Edificación, LOE), which start to run from the handover certificate, but also for its contractual liability as seller. It is liable because, in the sale, it did not deliver a product fit for the purpose for which it was bought, given that the defects in the sanitary traps and their consequences make living in these homes very difficult and unhygienic.
So if you are one of those affected by this or any other development handed over to you in a deplorable state, get in touch with us. We bring large-scale and collective lawsuits against major building contractors.
First, our technical department will prepare an expert report, by experts specialising in building pathology, recording all the damage in all the homes claimed for, proposing the appropriate repair method and costing it. On that basis, a formal demand will be sent to Servihabitat or to the liable developer, so that they either carry out the repairs in the manner our experts set out or pay compensation for that amount. If no agreement is reached in this out-of-court negotiation, the matter will have to go to court.
